1) Introduction & Acceptance

These Terms of Service (the “Agreement”) govern your use of the websites, products, and services provided by Intek Host (“Intek Host,” “we,” “us,” “our”), including intekhost.net and related portals (collectively, the “Services”).
By registering for, accessing, or using the Services, you agree to be bound by this Agreement. If you do not agree, do not use the Services.

1.1 Eligibility & Authority

• You represent that you are at least 18 years old and legally able to enter into this Agreement.

• If you use the Services on behalf of another person/entity, you warrant that you are authorized to bind that person/entity to this Agreement.

1.2 Accurate Information

You must provide accurate, current, and complete account information (including a reachable primary email different from the domain you’re registering). You are responsible for keeping your contact and billing details up to date via the Client Area. Intek Host is not responsible for service lapses (e.g., domain expiry) caused by outdated contact information.

1.3 Changes to This Agreement or Services

We may modify this Agreement or any part of the Services at any time. Material changes will be signposted on our website for at least 30 days and the “Last updated” date will change. Your continued use after the effective date constitutes acceptance of the changes.

2) Related Policies

Your use of the Services is also governed by:

• Acceptable Use Policy (AUP)

• Privacy Policy

• Refund Policy

These documents are incorporated by reference. If there is a conflict, this Agreement controls unless a policy expressly states otherwise.

3) Accounts, Content & Intellectual Property

3.1 User Content

For shared and similar plans, you may upload, store, publish, and distribute content (“User Content”). You are solely responsible for User Content and activities conducted on or through your websites (“User Websites”).

You warrant that:

• You have all rights and licenses necessary to post and distribute User Content; and

• Your User Content does not infringe third-party rights or violate laws or our AUP.

3.2 Intek Host Content & Software

All non-User Content available through the Services (designs, text, images, software, selection/arrangement, and underlying code) is Intek Host Proprietary Content. Except as expressly permitted, you may not copy, modify, reproduce, distribute, sell, or exploit any part of it. Unauthorized use terminates your rights to use the Services.

3.3 Migrations (Courtesy Service)

Our Account Transfers team will make reasonable efforts to assist with migrations.

• Up to 10 cPanel accounts may be migrated as a courtesy; additional accounts may incur a fee (e.g., GH¢50 per extra account).

• We must be able to obtain a full cPanel backup from your prior host and the compressed account size must be ≤ 1 GB.

• Migrations are best-effort and not guaranteed due to differences between environments.

4) Billing, Invoices & Payments

4.1 Price Changes

We may change prices, monthly charges, or other fees at any time. You agree to review billing information provided via email, the Client Area, or notices we post.

4.2 Free Domain Eligibility

Where offered, Free Domains apply only to Shared/WordPress/VPS plans with annual (or longer) billing cycles, as specified on our website.

4.3 Invoice Creation & Payment

• Upon signup, an invoice is generated. Full payment is required before we provision domains/hosting.

• Recurring invoices are generated 14 days before the renewal date. Failure to pay by the due date may result in suspension until full payment is received.

4.4 Payment Reminders

We send reminders to your primary email (and may occasionally call). Failure to receive a reminder does not waive your responsibility to pay.

4.5 Refunds

Our Refund Policy governs eligibility. In summary:

• 30-day money-back applies to Cloud Hosting and VPS Hosting (first-time purchases only), subject to exclusions (e.g., domains, setup, licenses, transfer fees).

• No refunds for domain registrations/renewals.

4.6 Suspension & Termination for Non-Payment

If fees remain unpaid for 30 days, we may suspend/terminate services. Data may be deleted upon termination and may not be recoverable. You remain responsible for charges through the date of termination.

4.7 Prepayment Application

Payments are applied to the oldest outstanding invoice first. You agree to pay for Services in advance of each service period.

5) Service Use, Resources & Uptime

5.1 Acceptable Use & System Integrity

You must comply with our AUP at all times. Prohibited activities include (without limitation) distributing malware, spamming, infringing IP, or abusing system resources.

5.2 CPU, Bandwidth & Disk Usage

• Shared hosting space is for website files, active email, and live site content only. It may not be used as offsite storage, general backups, or file-sharing repositories.

• We may review accounts for excessive use of CPU/disk/resources and, at our discretion, limit, charge, or terminate accounts causing degradation or violating our policies.

5.3 Uptime Commitment (Credit)

We target 99.99% cloud availability. If a shared server experiences physical downtime below 99.9% in a calendar month (excluding scheduled maintenance, force majeure, customer-caused issues, or third-party network problems), you may request one (1) month of service credit.

• Third-party monitors are not authoritative.

• Credits are at Intek Host’s sole discretion and are your exclusive remedy for downtime.

5.4 Maintenance & Changes

We may perform routine/emergency maintenance or upgrades without prior notice when necessary. We will minimize disruption where reasonably possible.

6) Domains & WHOIS

• All domain registrations/renewals are final and non-refundable (see Refund Policy).

• You are responsible for ensuring domain contact data is accurate and for timely renewals.

• Certain TLDs/uses (e.g., betting-related) may have different pricing/policies—contact Support for confirmation before purchase.

7) Data, Security & Backups

7.1 Security

You are responsible for securing your account credentials and keeping CMS/plugins/themes updated. Notify us immediately of any suspected compromise.

7.2 Backups

While we may maintain routine backups for our own continuity, you are solely responsible for independent backups of your websites, databases, and email. Intek Host is not liable for data loss or corruption. Backup restores may be offered as a best-effort courtesy and may incur fees.

8) Support Boundaries

We provide support for Services we provision and control. We may, at our discretion, assist with third-party apps/CMS as a courtesy, but such assistance is not guaranteed and may be billable.

9) Term; Cancellation & Termination

9.1 By You

You may cancel via our online cancellation form (authentication required). Upon receipt and confirmation:

• Fees accrued to the effective cancellation date remain due.

• Prepaid basic hosting for unused full months may be refunded at our discretion (if within policy and not in breach).

• No refunds after the 30-day money-back window.

Upon termination for any reason, User Content, websites, emails, and data may be deleted immediately and permanently.

9.2 By Intek Host

We may suspend/terminate immediately (with or without notice) if:

• You are 30+ days past due;

• You breach this Agreement or the AUP/Privacy/Refund policies;

• Your conduct risks harm or liability to us/others; or

• As otherwise provided herein.

Prepaid fees may be forfeited upon termination for cause.

10) Legal Terms

10.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTEK HOST, ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION) ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, INTEK HOST’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS RELATING TO THE SERVICES IN ANY THREE (3)-MONTH PERIOD SHALL NOT EXCEED THE FEES PAID BY YOU TO INTEK HOST FOR THE SERVICES DURING THAT SAME THREE-MONTH PERIOD.

10.2 Indemnification

You agree to indemnify, defend, and hold harmless Intek Host and its affiliates, officers, directors, employees, and agents from any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
(i) your use of the Services; (ii) your breach of this Agreement or our policies; or (iii) your acts/omissions.

10.3 Disclosure to Law Enforcement

We may disclose user information to law enforcement upon lawful request and will cooperate as required by applicable law.

10.4 Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” INTEK HOST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

10.5 Force Majeure

We are not liable for delays/failures caused by events beyond our reasonable control (e.g., natural disasters, acts of government, labor disputes, network or power failures).

10.6 Governing Law & Venue

This Agreement is governed by the laws of the Republic of Ghana, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Accra, Ghana.

10.7 Notices

We may provide notices via: (i) your primary email on file; (ii) the Client Area; or (iii) postings on our website. You must send legal notices to the address or email listed on our site’s Contact/Legal page.

10.8 Severability; Waiver; Entire Agreement

If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. This Agreement, together with incorporated policies, constitutes the entire agreement between you and Intek Host concerning the Services.

11) Affiliates Program Terms (Summary)

a) Eligible referrals earn a one-time commission when a new client uses your unique link, signs up within 30 days, and maintains an active paid account.
b) You may not copy our site, trademarks, or creative materials without prior written permission.
c) Keep your payment/tax/contact information accurate to receive commissions.
d) You are responsible for using the exact affiliate URL provided. Altered links that break tracking may forfeit commission.
e) No domain forwarding to cloak affiliate links.
f) Deception, misuse of IP, impersonation, or fraud may result in forfeiture of commissions and removal from the program.
g) We may deactivate accounts for suspected fraud or policy breaches at our sole discretion.
h) To stop participating, remove your links; we may retain records for accounting.
i) We may modify or terminate the program at any time; continued participation after changes constitutes acceptance.
